no later than 10 a.m., Local Time, Friday, October 29, 2021
at the Bay St. Louis City Hall Conference Room, 2nd Floor, City Hall,
688 Highway 90, Bay St. Louis, MS 39520.
All bids so received will be publicly opened and the bid amount read aloud for the following project:
OLD TOWN DEPOT REVITALIZATION
1928 DEPOT WAY
BAY SAINT LOUIS, MS 39520

The work included in the Contract shall consist primarily of the following items: Construction of 4
auxiliary buildings or structures and site improvements in the Old Town Depot park.

The above general outline does not limit in anyway the responsibility of the Contractor to perform all
work required by the specifications and plans.

The City of Bay St. Louis, Hancock County, MS hereby notified all Bidders that it will affirmatively
insure that in any contract entered into pursuant to this Advertisement, Disadvantaged and Women’s
Business Enterprises will be afforded the full opportunity to submit bids in response to this invitation and will not be discriminated against on the grounds of race, color or national origin in consideration for an award.

Bids must be submitted upon the standard forms contained within these contract documents furnished by the Architect, noted in the information for bidders.

The required bid documents shall be submitted in a sealed envelope and the outside of the envelope shall be marked plainly as: “Old Town Depot Revitalization Project” along with the Contractor’s name and Certificate of Responsibility Number.

Bids shall be deposited with the City of Bay St. Louis, Bay St. Louis City Hall, Mary Burch 2nd floor,
688 Highway 90, Bay St. Louis, MS 39520 or for those interested, bids can be electronically submitted at www.baystlouis-msbids.com under the project page, prior to the hour and date designated above. No oral, telegraphic, telephonic, or email proposals will be considered. All interpretations of drawings and specifications shall be directed to Michael Reeves Architects, PLLC by email to:
mreeves.architect@gmail.com An acknowledged copy of all Addenda issued by the Architect via Plan House must be included with the Bid Proposal. No bidder may withdraw his bid within sixty (60) days
after the date of actual bid opening without Owner’s consent.

PREBID MEETING: A Prebid meeting for all bidders will be held at the Old Town Depot located at 1928 Depot Way, Bay Saint Louis, MS 39520 at on October 12, 2021 at 2 p.m. local time. Prospective prime bidders are requested to attend. Bidders questions will be received up to 2 business days prior tovmeeting.

TIME OF COMPLETION AND LIQUIDATED DAMAGES: Successful bidder shall begin work on
receipt of Notice to Proceed and shall complete the Work within the Contract Time. Work is subject to
liquidated damages.

BIDDER’S QUALIFICATIONS: Bidders must be properly licensed under laws governing their
respective trades and be able to obtain insurance and bonds required for the Work. A Performance Bond, separate Labor and Material Bond and Insurance in a form acceptable to Owner will be required of the successful Bidder. Project to be coordinated in compliance with requirements for a historic landmark per Mississippi Department of Archives and History. Those qualifications shall be included with the bid package.

BID GUARANTEE: Proposals shall be submitted with Proposal Security in the form of Certified Check
or acceptable Bid Bond in an amount equal to at least five percent (5%) of the base bid; such security to be forfeited as liquidated damages, not penalty, by any bidder who fails to carry out the terms of the proposal. The Bid Bond, if used, shall be payable to the Owner. Bonds on the project must be received on or before the period scheduled for the project and no bid may be withdrawn after the scheduled closing time for the project. Bids must be firm for a period of sixty (60) days after the scheduled time of opening.

PERFORMANCE-PAYMENT BOND: A 100% Performance-Payment Bond issued by a surety company authorized to do business in the State of Mississippi will be required within ten (10) days after the successful bidder has been notified of the award of the contract.

CERTIFICATE OF RESPONSIBILITY: All bids submitted by a prime contractor or subcontractor for public works or public projects where said bid is in excess of fifty thousand dollars ($50,000) to perform contracts enumerated in Section 31-3-21, Mississippi Code of 1972, shall contain on the outside or exterior of the envelope, or container of such bid, the contractor’s current certificate number. No bid shall be opened or considered unless such contractor’s current certificate number appears on the outside or exterior of said envelope or container, or unless there appears a statement on the outside or exterior of such envelope or container to the effect that the bid enclosed therewith did not exceed fifty thousand
dollars ($50,000).

BID OPENING: All bids will be publicly opened October 29, 2021 at 10 a.m.

The Owner reserves the right to reject any or all bids and to waive irregularities. By the submission of the bid, bidder waives any right to seek or recover damages or loss from Owner not accepting and/or rejecting the bid.

Work to be performed shall be in accordance with all Federal, State and Local Regulations and Codes.
